Following the release of a scathing whistleblower report by the U.S. Bureau of Land Management’s lead investigator, Larry Wooten, which accused FBI agents of far-reaching misconduct, recklessness and unrestrained antipathy toward the Bundy family, one of the co-defendants in the case, Ammon Bundy, has spoken out in a passionate video message.

The Oregonian/OregonLive obtained a copy of the 18-page whistleblower report, which was dated Nov. 27. The trial against Cliven Bundy and his sons, Ammon and Ryan, along with co-defendant Ryan Payne, began Nov. 14 in Las Vegas.

After being held in prison for the past two years, Ammon and Ryan Bundy were both granted a limited release recently by the judge while the trial is ongoing, after the prosecution failed to show evidence why they should be kept imprisoned during the trial.

The memo from Wooten prompted Cliven Bundy’s lawyer to file a motion early Monday to dismiss the case. There’s already an issue regarding the government’s failure to promptly share evidence with the defense.

In response, U.S. District Judge Gloria M. Navarro sent the jury home for more than a week as she attempts to sort out the claims and prosecutors scramble to save their case.

LAS VEGAS - A federal judge Wednesday declared a mistrial in the prosecution of Nevada cattleman Cliven Bundy, his two sons and a co-defendant, citing the government's "willful'' failure to turn over multiple documents that could help the defense fight conspiracy and assault charges in the 2014 Bunkerville standoff.

"The court does regrettably believe a mistrial in this case is the most suitable and only remedy,'' U.S. District Judge Gloria M. Navarro declared, issuing her ruling from the bench before a packed courtroom.

The judge listed six types of evidence that she said prosecutors deliberately withheld before trial, including information about the presence of an FBI surveillance camera on a hill overlooking the Bundy ranch and documents about U.S. Bureau of Land Management snipers outside the ranch.

The others were maps, an FBI log with entries about snipers on standby, threat assessments that indicated the Bundys weren't violent and that the Bureau of Land Management was trying to provoke a conflict by antagonizing them and nearly 500 pages of internal affairs documents involving lead bureau special agent Dan Love, since fired from the agency.

The material, the judge found, would bolster the defense stance that defendant Ryan Payne put a call out for support because the Bundys feared they were surrounded by snipers and felt isolated in early April 2014 before the standoff with federal rangers and officers on April 12, 2014. The federal officers were carrying out a court-ordered roundup of Bundy cattle for failure to pay grazing fees and fines for two decades.

In identifying the Misdeeds of Government, it requires a diligent search of available information. However, often that research produces some interesting results. That is the situation with this article, since it begins with events surrounding the arrest of Dave Bundy (The Bundy Affair – #12 – Dave Bundy’s Two Citations), on April 6, 2014, and ends with the declaration of Mistrial on Decembers 20, 2017. However, in that span of time, over three and a half years, the following events played out.

Dave Bundy was pulled over on Nevada State Highway 170, a road that goes from Interstate 15, near the road to the Bundy Ranch, to Bunkerville. The Bureau of Land Management (BLM) had attempted to close the highway.

Dave got into a dispute with the BLM and was arrested and charged with two citations (explained in the linked article above). It is this arrest that begins this series of events. First, we have, from the National Park Service “DIRECTOR’S ORDER #9: LAW ENFORCEMENT PROGRAM”, which, on page 2, explains when and where arrests may be made.

In this video you will clearly hear the BLM order to defy the County Sheriff when
he tells them to keep their "long guns back". He says "they aren't needed.
It appears it was the Sheriff and not BLM AGENT Dan Love (fired) that was trying to
de-escalate the situation caused by what has now been revealed the
heavy handed militarized intimidation on the Bundy Ranch.

You may not support the Occupiers for the Malheur Refuge or the Bundy Standoff and that is a personal choice or decision made by each of us as an individual. At this point, these issues should be moot with all of us.

The underlying issue and concern I have is how far our representative government has gone to fudge, lie, cheat, manipulate, falsify, withhold, deny, cover up, doctored, abuse and misuse their positions at our expense and go so far to see that they broke not only the rules but the public trust. When our government goes as far as they did to do whatever it took to see these people imprisoned and jailed for literally two years.

This maneuver and tactics utilized should have us all outraged. It leaves an err of questioning as to what else and who else before has had to go down this road and a wonder of who else has been falsely and wrongfully prosecuted and convicted.

When we are at a time in society that our government will break the law to enforce the law, and where people will not unite to ensure that this shall never happen to another single citizen, I have to wonder if we are still a free nation. These actions are what you would expect to see or witness coming from a Third World Country or a foreign nation. Not the United States of America.

Allowing this to happen and to condone that fellow citizens were treated as they were and locked away for two years is literally horrid. Our Judicial system failed these people and there has got to be accountability.

Yep, Dan Love became a "whistleblower" to cover his own butt, and so did another federal agent, but they should not be protected because they were the ones engaging in the illegal activity. Whistleblower protections should not be given to those who willfully and knowingly engage in misconduct and criminal activity and then seek to skirt prosecution by claiming they are now a whistleblower. You can't have it both ways.

Additionally, Wooten's letter would go on to state the behavior among the BLM leadership was more than disgusting and that former BLM Special Agent-in-Charge Dan Love had a kill list.

Wooten wrote, "Prior to taking the assignment as Bundy/Gold Butte investigation Case Agent/Lead Investigator for the FLM/DOI, I didn't know and had never spoken to former BLM SAC Dan Love. I was new to the agency and I was also specifically directed to lead an unbiased, professional, and independent investigation, which I tried to do, despite supervisory misconduct."

"I was told by BLM law Enforcement Supervisors that he has a 'Kill Book' as a trophy and in essence bragged about getting three individuals in Utah to commit suicide (see Operation Cerberus Action out of Blanding, Utah and the death of Dr. Redd), the "Failure Rock," Directing Subordinates to Erase Official Government Files in order to impede the efforts of rival civilian BLM employees in preparation for the "Burning Man" Special Event, unlawfully removing evidence, bragging about the number of OIG and internal investigations on him and indicating that he is untouchable, encouraging subordinates not to cooperate with internal and OIG investigations, his harassment of a femal Native American subordinate employee where Mr. Love allegedly had a doll that he referred to by the employee's name and called her his drunk little Indian, etc., etc., etc."

There were other indications of bias and possible kill list targets.
